The strata conversion of existing residential flat buildings including company title conversions are becoming increasingly popular among our client base, and we regularly prepare these types of development applications and plans.
There are a number of issues to be considered and addressed as part of this style of development including:
Building Fire Protection upgrade requirements to comply with current BCA standards. (an accredited building inspector is commissioned to inspect the existing building and recommend required building upgrades to satisfy this requirement).
Possible Affordable Rental Housing SEPP (formally SEPP 10) implications should the existing building be rented below NSW Department of Planning low rental thresholds. (The Department of Planning updates their low rental thresholds for individual LGA’s on a quarterly basis).
Individual council planning requirements for the strata conversion of residential flat buildings.
We have a good working relationship with Local Councils and the Department of Planning and have successfully negotiated with the Department to enable the strata subdivision of a large number of Affordable Rental Housing SEPP (formally SEPP 10) affected buildings.
